Studying metaphor to study Chinese law

Around thirty years ago, George Lakoff and Mark Johnson (1980)* radically shifted the paradigm of metaphor from the so called “traditional view” to the “cognitive view”. Traditionally, metaphor was regarded as a literary and poetic device used to create vivid and colourful language. However, in the cognitive or conceptual view introduced by Lakoff and Johnson, metaphor is seen as a fundamental cognitive tool that shapes not only how we speak but also how we think and act. When a contract stipulates that it has a “binding” force
(yuēshù lì 约束力), we not only think of it as having a binding force, but we also act accordingly by performing certain deeds while refraining from others.

This lecture focuses on the study of metaphor to study Chinese law from the cognitive perspective. It aims at answering basic yet fundamental questions, such as :
